1. Acceptance of Terms

By downloading, installing, or using any Koala Learners application ("Apps"), including but not limited to Koala ABC, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Apps.

If you are a parent or guardian allowing your child to use our Apps, you agree to these Terms on behalf of your child and are responsible for your child's use of the Apps.

2. Description of Service

Koala Learners provides educational mobile applications designed for children. Our Apps offer interactive learning experiences covering subjects such as letters, numbers, geography, mathematics, and science. The Apps are intended for entertainment and educational purposes only.

3. User Eligibility

Our Apps are designed for children. If you are under the age of 18, you should review these Terms with your parent or guardian to make sure that you and your parent or guardian understand these Terms. Parents and guardians are responsible for supervising their child's use of our Apps.

4. License Grant

Subject to your compliance with these Terms, Koala Learners grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Apps for personal, non-commercial, educational purposes on devices that you own or control.

You may NOT:

• Copy, modify, or distribute the Apps or any content within them
• Reverse engineer, decompile, or disassemble the Apps
• Remove or alter any proprietary notices or labels
• Use the Apps for any commercial purpose
• Transfer your license to any third party
• Use the Apps in any way that violates applicable laws or regulations

5. Intellectual Property

All content in our Apps, including but not limited to text, graphics, images, audio, video, animations, and software, is the property of Koala Learners or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The Koala Learners name, logo, and all related product and service names, designs, and slogans are trademarks of Koala Learners. You may not use these marks without our prior written permission.

6. In-App Purchases

Some of our Apps may offer in-app purchases. All purchases are final and non-refundable, except as required by applicable law or the policies of the respective app store (Apple App Store or Google Play Store).

Parents and guardians are responsible for managing in-app purchases and should enable appropriate parental controls on their devices to prevent unauthorized purchases.

7. Updates and Changes

We may update or modify our Apps from time to time. Updates may be required for continued use of the Apps. We reserve the right to modify, suspend, or discontinue any App or feature at any time without prior notice.

8. Disclaimer of Warranties

OUR APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Apps will be uninterrupted, error-free, or free of viruses or other harmful components. While our Apps are designed to be educational, we do not guarantee any specific educational outcomes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOALA LEARNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use our Apps
• Any unauthorized access to or use of our servers or any personal information
• Any interruption or cessation of transmission to or from our Apps
• Any bugs, viruses, or other harmful code that may be transmitted through our Apps

10. Indemnification

You agree to indemnify, defend, and hold harmless Koala Learners and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our Apps or violation of these Terms.

11. Third-Party Services

Our Apps are distributed through third-party app stores (Apple App Store and Google Play Store). Your use of these platforms is subject to their respective terms and conditions. We are not responsible for any third-party services or their practices.

12. Termination

We may terminate or suspend your access to our Apps at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Apps will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Apps shall be resolved in the appropriate courts.
